New Guidance on Collective Redundancy

As from 6 April 2013 the minimum consultation period when 100 or more redundancy dismissals are proposed has been reduced from 90 days to 45 days.  Further to this, ACAS has issued new guidance on how to handle collective redundancies.  Among other things, this guidance sets out case studies and gives a 10-point checklist for handling collective redundancies. New National Minimum Wage from 1 October 2013

From 1 October 2013 the adult rate for the national minimum wage will increase from £6.19 to £6.31 per hour.  The rate for 18 to 20 year olds will also increase by 5p to £5.03 per hour and the rate for 16 to 17 year olds will increase by 4p to £3.72 per hour.  The apprentice rate will also increase to £2.68 per hour.

Disability Discrimination

In the recent European Court of Justice ("ECJ”) case of HK Danmark (on behalf of Ring) v Dansk almennyttigt Boligselskab and another, the ECJ has confirmed that "disability" covers curable or incurable illnesses resulting in long term physical, mental or physical impairment  which may hinder full and effective participation in professional life on an equal basis with other workers.  This confirms that disability is not intended to be limited to disabilities that are congenital or result from accidents and the ability to work to a limited extent does not prevent someone from being covered by the concept of disability.
